1. Introduction

Welcome to Starboy Networks. These Terms of Service ("Terms") govern your use of our internet services, website, and any related services provided by Starboy Networks ("Company," "we," "us," or "our").

By subscribing to our services or using our website, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

2. Service Description

Starboy Networks provides fiber-to-the-home (FTTH) internet services in Athi River and surrounding areas. Our services include:

  • High-speed fiber internet connectivity
  • Installation of necessary equipment (ONT and router)
  • Technical support and maintenance
  • Customer portal access for account management

Service availability is subject to coverage in your area. We reserve the right to modify or discontinue services with appropriate notice to customers.

3. Subscription and Billing

3.1 Subscription Plans

We offer various subscription plans with different speeds and pricing. All plans include unlimited data usage. Plan details and pricing are available on our website and are subject to change with 30 days notice.

3.2 Payment Terms

  • Payment is due on your billing date each month
  • We accept M-Pesa, bank transfers, and cash payments
  • A 3-day grace period is provided after the due date
  • Services may be suspended for non-payment after the grace period
  • Reconnection fees may apply for suspended accounts

3.3 Refund Policy

Subscription fees are non-refundable once the billing cycle has begun. If you experience service issues, please contact support for resolution or service credits where applicable.

4. Acceptable Use Policy

You agree to use our services responsibly and lawfully. The following activities are prohibited:

  • Illegal activities including hacking, fraud, or distribution of illegal content
  • Sending spam or unsolicited bulk communications
  • Distributing malware, viruses, or other harmful software
  • Infringing on intellectual property rights
  • Reselling or sharing your connection without authorization
  • Activities that negatively impact network performance for other users

Violation of this policy may result in immediate suspension or termination of your service without refund.

5. Equipment

Equipment provided by Starboy Networks (including ONT and router) remains the property of the Company. You agree to:

  • Use the equipment only for its intended purpose
  • Not modify, tamper with, or attempt to repair the equipment
  • Report any equipment malfunction promptly
  • Return equipment in good condition upon service termination

You may be charged for damaged, lost, or unreturned equipment at replacement cost.

6. Service Level

We strive to maintain 99.9% uptime for our services. However, we do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance when possible.

Internet speeds are provided on a "best effort" basis and may vary based on network conditions, device capabilities, and other factors. The speeds listed in your plan represent maximum achievable speeds under optimal conditions.

7. Privacy and Data

We collect and process personal data in accordance with applicable data protection laws. Information we collect includes:

  • Contact information (name, address, phone, email)
  • Billing and payment information
  • Service usage data for network management
  • Technical data for troubleshooting

We do not sell your personal information to third parties. Data may be shared with service providers who assist in delivering our services, subject to confidentiality agreements.

8. Limitation of Liability

To the maximum extent permitted by law, Starboy Networks shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of data, revenue, or business opportunities
  • Service interruptions beyond our reasonable control
  • Actions of third parties on the internet

Our total liability shall not exceed the amount paid by you for services in the 3 months preceding the claim.

9. Termination

You may terminate your service at any time by contacting our support team. Please provide at least 7 days notice before your next billing date to avoid charges for the following month.

We may terminate or suspend your service immediately if you:

  • Violate these Terms or our Acceptable Use Policy
  • Fail to pay for services after the grace period
  • Provide false information during registration
  • Engage in activities harmful to our network or other users

Upon termination, you must return all Company equipment within 14 days.

10. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or notice on our website at least 30 days before taking effect. Your continued use of our services after changes become effective constitutes acceptance of the updated Terms.
